  • (a) Transnational corporations and other business enterprises shall respect the right to a clean and healthy environment in the light of the relationship between the environment and human rights; concerns for intergenerational equity; internationally recognized environmental standards, for example with regard to air pollution, water pollution, land use, biodiversity and hazardous wastes; and the wider goal of sustainable development, that is, development that meets the needs of the present without compromising the ability of future generations to meet their own needs.

  • The Central American Commission on Environment and Development (CCAD) and the Permanent Secretariat of the General Treaty on Central American Economic Integration (SIECA), regional bodies with responsibility for matters relating to the environment, development and economic integration, had proposed a series of agreements on biodiversity, hazardous waste and forests, including the Convention on the conservation of biodiversity and protection of priority wilderness areas in Central America, the regional Convention on transboundary movements of toxic waste, the regional Convention on forests and the Central American Convention on climate change.

  • The Act regulates (among other things) “hazardous substances” (substances which, due to their nature, condition and quantity are toxic and capable of posing an immediate or long-term risk to human health or the environment) and “hazardous waste” (toxic, inflammable, corrosive, reactive, infective or explosive waste, and includes waste which is potentially hazardous to human health or the environment) and “pollutants” (dredged spoil, solid or liquid waste, industrial municipal or agricultural waste, incinerator residue, sewage, sewage sludge, garbage, chemical waste, hazardous waste, biological material, radioactive materials, wrecked or discarded equipment, oil or any oil residue and exhaust gases or other similar matter).
